Domestic Violence: Criminal Charges And Restraining Orders

  • Criminal charges — Domestic assault can be a misdemeanor or felony offense, depending on injury, prior offenses and other factors.
  • Permanent restraining orders — You can be removed from your home and prevented from seeing your children. We will represent you in the court hearing if the victim seeks to extend a temporary order.
  • Restraining order violations — Although restraining orders are civil in nature, breaking the no-contact provision or stalking or harassing the person may trigger criminal charges.

Most counties offer a deferred sentence for domestic violations.
